Copyright Infringement Notification

Required Information for DMCA Notice
To be effective, your DMCA notice must include the following information:
Identification of Copyrighted Work
A description of the copyrighted work that you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
Identification of Infringing Material
Identification of the material that is claimed to be infringing, including the URL(s) or other specific location on our platform where the material is located.
Contact Information
Your name, address, telephone number, and email address.
Good Faith Statement
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
Accuracy Statement
A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Physical or Electronic Signature
Your physical or electronic signature (or that of the person authorized to act on behalf of the copyright owner).

Our Response Process
Receipt & Review
We receive your DMCA notice and verify it contains all required information.
Within 24 hoursInvestigation
We investigate the claim and locate the allegedly infringing material on our platform.
24-48 hoursContent Removal
If the claim is valid, we remove or disable access to the infringing material.
Within 72 hoursNotification
We notify the user who posted the material and provide them with your DMCA notice.
After removalConfirmation
We send you confirmation that the material has been removed or access disabled.
Within 5 business daysCounter-Notification Procedure
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement consenting to the jurisdiction of federal court in your district
Repeat Infringer Policy
Account Termination
We have a policy of terminating user accounts of repeat infringers in appropriate circumstances. This includes:
- Users who receive multiple valid DMCA takedown notices
- Users who repeatedly upload copyrighted content without authorization
- Users who abuse our platform for copyright infringement
Determination Process
Our repeat infringer determination considers:
- The number of DMCA notices received for a user's content
- The validity and accuracy of those notices
- Whether the user has filed valid counter-notifications
- The user's overall compliance with our terms of service
Safe Harbor Compliance
Batoto complies with the safe harbor provisions of the DMCA. We:

Do not have actual knowledge of infringing activity on our platform
Expeditious Removal
Act expeditiously to remove infringing material upon notification
No Financial Benefit
Do not receive financial benefit directly attributable to infringing activity
Repeat Infringers
Terminate accounts of users who are repeat infringers

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Do not make false claims.

- You own the copyright or are authorized to act on behalf of the copyright owner
- You have identified the correct infringing material
- Your claim is made in good faith
International Copyright
While the DMCA is US law, we respect copyright laws worldwide and will respond to valid copyright complaints from international copyright holders following similar procedures and requirements.
